General Terms:

In the following terms and conditions the "Videographer" shall mean the member(s) of Wedding Film Solutions. The "Client" shall mean the person who submits this form, provides a digital signature, and completes the purchase of product. The "Event" is defined as the wedding, elopement, or other event that is specified in the Wedding Details form and occurs on the specified Wedding Date at the time of purchase by the Client. Coverage will be the amount of hours specified in the Classic, Deluxe, or Custom package at time of purchase by the Client. All video will be recorded in digital HD format. If the Short Film and/or Feature Film package option is purchased, the edited video(s) will be available for preview by the Client within 12 weeks after the date of the Event.

Fees and Product Deliverables:

The Total Fee is the full price specified in the Classic, Deluxe, or Custom package at time of product purchase. The 50% Deposit Fee is half of the full price of any selected package. If the Client chooses to book services by paying the 50% Deposit Fee option then the remaining 50% of the package price must be paid at least one week prior to the Event. No services by Wedding Film Solutions will be provided until the remaining balance of the package is paid by the due date (one week prior to the Event). The 50% Deposit Fee is non-refundable and the client forfeits provision of services by Wedding Film Solutions if the remaining balance is not paid one week prior to the Event or if the Event is canceled for any reason. If the short film and/or feature film package option is purchased, a video(s) will be provided to the client with various clips of the Event edited together. If the raw footage option is purchased, a majority of unedited video and audio clips of the Event will be delivered to the client. After the client previews and approves the short film and/or feature film, the content will be delivered via an online file sharing service or mailed on a USB flash drive.

Date Reservation and Cancellation:

Upon the Client’s submission of this agreement and payment of the required 50% Deposit Fee or Total Fee, the Videographer shall reserve the date of the Event and decline other potential bookings for that date. For this reason, all payments made are non-refundable. If the Client cancels the Event for any reason not covered under the Force Majeure clause below, including but not limited to change of plans, budget changes, personal decisions, or substitution of another vendor, all payments made, including the Deposit Fee and/or Total Fee, shall be retained by the Videographer. If the Client wishes to reschedule the Event, including any change to the Event date and/or location, the Client must first consult with the Videographer and receive written confirmation of availability and acceptance of the new date and/or location. If the Videographer confirms availability and agrees to the rescheduled location, all payments made shall transfer to the new event date and/or location. Additional travel fees or location-based costs may apply and shall be agreed upon in writing before rescheduling. If the Videographer is unavailable or determines the newly requested location is not feasible, the Event shall be considered canceled by the Client, and all payments made shall remain non-refundable.

Force Majeure:

If the Event is unable to occur due to circumstances beyond the control of either party, including but not limited to acts of God, natural disasters, fire, strike, government orders, venue closure, or other emergencies, both parties shall be released from further performance obligations under this agreement. In such circumstances, the Client may elect to reschedule the Event, including any change to the Event date and/or location, provided the Client first consults with the Videographer and the Videographer confirms availability and acceptance of the new date and/or location in writing. If the Videographer confirms availability and agrees to the rescheduled date and/or location, all payments made shall transfer to the new event date and/or location. Additional travel fees, lodging, or location-based expenses may apply and shall be agreed upon in writing before rescheduling. If the Event cannot be rescheduled, or if the Videographer is unavailable or determines the newly requested location is not feasible, all payments made shall remain non-refundable, as the original date of the Event was reserved and other work declined.

Postponement Limitation:

Any rescheduled Event date must occur within twelve (12) months of the original Wedding Date at the time of booking. If the Client elects to reschedule beyond twelve (12) months from the original Wedding Date, the Event shall be considered a cancellation, and all payments made shall remain non-refundable. If the Event is successfully rescheduled within the twelve (12) month period and confirmed in writing by the Videographer, all payments made shall transfer to the new approved date and location, subject to any additional travel fees, if applicable.

Content Promotion and Usage:

A tag will be included at the end of the short film and/or feature film which will promote Wedding Film Solutions services. The Client will have unlimited personal use of the video(s) at any time for no additional fee. The Client gives permission for the Videographer to use the work for publication, display, advertising promotion and other uses. The short film may be published online or on any other source of public media. The feature film and/or raw footage is for the Client's personal use only and may not be published online or on any other source of public media.

Limited Liability:

While the Videographer takes the utmost care with respect to transferring, processing and
delivery of video, in the event that the footage becomes lost, stolen or destroyed, for reasons within or beyond the control of the Videographer, liability is limited to a refund of the payment received at time of the product's purchase. The limit of liability shall not exceed the product's Total Fee. The Videographer will not be held responsible for any ruined footage due to guests’ (or any other) flashes; or any other ruined footage due to any other cause in or outside of the Videographer's control. In the event that the Videographer is unable to provide services for the reserved wedding date due to: illness, emergency, accident, or Act of God, every effort will be made to find a suitable replacement. If a replacement is unavailable, the Total Fee or 50% Deposit Fee at the time of the product's purchase will be refunded in full, and return of payment shall be the entire obligation under these terms and conditions. No other damages or guarantees of any kind are recognized or warranted.

Digital Signature and Purchase Completion:

These Terms and Conditions incorporates the entire understanding of the Client and Videographer. Any modifications of these terms must be in writing and signed by both parties.
